1. 接受条款
By creating an Effable account or using the service, you agree to these Terms. If you don’t agree, don’t use Effable. We may update these Terms; we’ll notify you and require renewed consent when changes are material.
2. 你的账号
You’re responsible for activity under your account. You must be 13 or older (16 in the EEA / UK) and be authorized to bind any organization you represent. Use real, current information.
3. 你的内容（上传素材与 AI 分身）
You retain ownership of everything you upload — source materials (blog posts, video, images, PDFs), the distilled AI clone, and any conversations exported by you. You grant Effable a limited, non-exclusive, worldwide, royalty-free license to process, host, and serve your content for the sole purpose of running the service you signed up for, including:
- storing source materials in our object storage,
- distilling them into your AI clone via our worker pipeline,
- serving your clone to humans at effable.me/<handle> and to MCP clients at mcp.effable.me/<handle>,
- computing aggregate analytics that don’t identify individuals.
Revoke any time. We’ll tombstone your content and purge backups within 90 days.
4. 可接受使用方式
You won’t use Effable to:
- impersonate another person without their consent,
- distill content you don’t have rights to (copyright, trade secret),
- create clones that produce CSAM, real-world weapon synthesis, targeted harassment, or other illegal output,
- circumvent rate limits, abuse APIs, or attempt to extract our system prompts.
Violations are grounds for suspension without refund.
5. 支付
Effable revenue comes from agent calls, not from human chat. Agents pay per call via x402 (USDC on Base) or via API key + metered Stripe. Platform fees apply per the Pricing page. Payouts to creators happen on a rolling basis subject to minimum thresholds. We may withhold payouts when an investigation is open.
6. 第三方服务
Effable uses subprocessors, including Anthropic (LLM inference), Supabase (database, auth, storage), Stripe (metered billing), Coinbase Commerce / x402 facilitator (crypto payments), Modal (compute), and Cloudflare (edge / MCP). A complete list lives in our Privacy Policy.
7. 免责声明与责任
Effable is provided “as is”. To the maximum extent permitted by law, Wish-Machine is not liable for indirect, incidental, special, or consequential damages, and total liability is capped at the greater of $100 or amounts you paid in the prior 12 months.
8. 终止
You can close your account anytime in Settings. We can suspend or terminate accounts for violations or extended inactivity (12 months without sign-in). On termination, your data is deleted per our retention schedule unless legal hold applies.
9. 适用法律
These Terms are governed by the law of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes go to binding arbitration in San Francisco, except small-claims actions you may bring in your local court.
